As of March 29, 2011, the following KFS Use License is current. The Ewing Marion Kauffman Foundation reserves the right to amend its KFS Use License from time to time as necessary in the judgment of its staff and directors to meet its goals. Please check this site periodically, and before any new use of the public-use data file, for the current KFS Use License. By downloading and using the Kauffman Firm Survey public-use data file, you agree to abide by the terms of this KFS Use License.

The Ewing Marion Kauffman Foundation owns the copyright in the Kauffman Firm Survey public-use date file.

Permitted uses: Provided you register on the KFS site and comply with the following restrictions and requirements, you may download and use the KFS public-use data file consistent with the principles of fair use, and/or for educational, non-profit research or other non-profit purposes. In most cases, we will not consider republication of a substantially complete copy of the KFS public use-data file to be fair use.

Restrictions on use: You may not republish a substantially complete copy of the KFS public-use data file for political purposes or in connection with grassroots lobbying, and you may not charge fees or tie advertising or other revenue streams to your republication of a substantially complete copy of the KFS public-use data file.

Conditions of use:  To facilitate accurate use of the data, you agree to make a good faith effort to follow the recommended best practices for use of the KFS data (such as weighting correctly, describing the sample correctly, etc) and to work in good faith with the Foundation or its representatives to accurately communicate research resulting from the KFS data.

User-generated content:  Registration for the KFS public-use data file allows you to contribute information and data through the interactive elements of the KFS website (including the KFS wiki ).  The Foundation does not claim ownership in your contributions to the website (your Content).  However, when you contribute Content to the KFS website, you grant to the Foundation, and you represent and warrant that you have the right to grant to the Foundation, an irrevocable, perpetual, non-exclusive, transferable, royalty free, worldwide license (with the right to sublicense) to copy, publicly perform, publicly display, reformat, translate, excerpt, distribute, create derivative works from and otherwise use such Content for any purpose on or in connection with the KFS data.  You understand that this Agreement does not guarantee that your Content will be included in the KFS website, wiki or any KFS data files.  Further, the Foundation may remove your Content from the website at any time and has no obligation to notify you of removal.

Acknowledgement: By downloading and using the KFS public-use data file, you agree to include a reference in any Publication (a formal publication, on a Web site, or in some other venue will be considered “Publications”) utilizing the KFS public-use data file as follows:

Certain data included herein are derived from the Kauffman Firm Survey release 5.0 public-use data file.  Any opinions, findings, and conclusions or recommendations expressed in this material are those of the author(s) and do not necessarily reflect the views of the Ewing Marion Kauffman Foundation.

Dissemination: The Kauffman Foundation seeks to enable broad public access to any research results, reports, or articles that may be generated as a result of its support of the Kauffman Firm Survey. As such, by downloading and using the KFS public-use data file, you agree to post all Publications in the Entrepreneurship Research & Policy Network (ERPN) of the Social Science Research Network (SSRN). To the extent that you have the right to do so, the reference shall include the actual Publication and an abstract of the full Publication.

The SSRN repository can include working papers, PDFs of PowerPoint presentations, reports, book chapters, as well as citations for published papers.
